State Capitol Report   February 11, 2008

As we enter the “crossover” point of the 2008 session, legislators will have handled more than 2800 bills. The budget and Senate bills that cross over to the House will demand full attention. Money is tight this year due to declining revenues, so I am very concerned with the local funding mandates proposed by the Governor for CSA, K-12 educational funding in general, and higher education capital spending.

Some of the more publicized bills in the House have been the attempt to repeal the right-to-work law, establish background checks for individual firearm transactions, and remove the “trigger man” restriction from capital punishment.

As for the right-to-work bill, requiring local governments to negotiate with unions for public safety, law enforcement, and school employees is not the proper course for the Commonwealth, in my opinion. I voted against the bill.

Individual firearms transactions always have been and should continue to be permitted in Virginia. Although the tragedy at Virginia Tech is often referenced by supporters of firearm restrictions, the fact is the failure in that case was in the mental health system, not firearms laws.

I voted to repeal the transportation bill’s abuser fees but supported an effort on the House floor to reinstate them for the most grievous violations, such as causing serious bodily injury or death to a person or persons by someone guilty of DUI. The effort failed.

I have sponsored several bills and co-patroned many others. Two of my bills made it through the House and into the Senate for approval. My House Bill 756 provides that registration fees for vehicles specially equipped to accommodate persons with disabilities will be based on the weight of the vehicle prior to the installation of such special equipment. My House Bill 758 provides that computers and related equipment would be exempt from sales tax when purchased during the August sales tax holiday.

Several of my bills have been assigned to special commissions for more study. I will present them again in 2009. These include a bill to encourage distributed electricity generation via sources available in the 9th District, such as woody biomass and other sustainable materials. Another bill establishes a statewide privately financed and state regulated system to repair stream polluting faulty septic systems. This bill has been assigned to the Virginia Housing Commission chaired by Virginia Beach Delegate Terrie Suit. I look forward to working with her and the Commission to get this legislation ready for the next session.

In addition, I have patroned budget amendments requesting funds for the Franklin County Historical Society, the Floyd County Historical Preservation Trust, the Jubal A. Early Preservation Trust, and the Blue Ridge Foundation. I have patroned budget amendments to secure funding for Smith Mountain Lake water quality monitoring, treatment and control for Hydrilla and other invasive vegetative species, and for the maintenance of the navigation aids system.

I patroned budget amendments to fund staffing for our new regional jail. I was pleased to introduce Franklin County Sheriff Ewell Hunt to the Appropriations Subcommittee and jointly presented the amendment to them. I also co-patroned a bill with Delegate Don Merrick to permit the City of Danville and Pittsylvania County to build a regional jail without including a third jurisdiction. That bill failed to pass.

Other bills or budget amendments I have co-patroned include supporting the proposed Farm Bureau agriculture facility on Route 29 and the designation of one-tenth of a cent of the sales tax to provide funding for Agricultural BMP’s to prevent non-point runoff into our impaired streams.

At the request of Attorney General Bob McDonnell, I carried a bill to deny bail to criminal illegal aliens. The bill was folded into a similar bill. I anticipate that version of the bill to pass the House.

Many constituents and groups from home have visited recently. I was proud to welcome both the Floyd and Franklin County School Boards and Superintendents; Pittsylvania County’s Administrator Dan Sleeper and Board of Supervisors members Coy Harville and James Snead; members of the Franklin County Education Association, representatives of Rocky Mount’s Southern Virginia Child Advocacy Center, and the Floyd County Department of Social Services; Rocky Mount Town Manager James Irvin and Assistant Town Manager Matt Hankins accompanied by Vice-Mayor Roger Seale and Town Council member John Lester. Sandy Level’s Janet Mease was among a group of citizens who stopped by to say hello before addressing a Senate committee regarding the uranium mining issue.

I am always delighted to greet our 9th District college students when they come to visit the General Assembly. Last week’s visitors included Rocky Mount’s Samantha Robertson—a student at Bridgewater College and granddaughter of my friend Marshall Blair from Penhook. My staff and I also welcomed students Chris Cooper of Glade Hill, Franklin County’s Brenda Sigmon—a student at Patrick Henry Community College, and Rocky Mount’s Denise Corbin—a student at Virginia Western Community College.
